Screen Australia has announced that the Department of the Treasury has released an exposure draft of legislation which would introduce definitions of ‘documentary’ and related terms into Division 376 of the Income Tax Assessment Act 1997.

The media release notes that the draft legislation, if enacted, would impact on the Producer, Location and PDV Offsets.

According to the explanatory material, the draft legislation defines ” ‘documentary’ to be a creative treatment of actuality. It is also defined to exclude ‘infotainment or lifestyle programs’, and films that present factual information in multiple parts without an over-arching narrative structure or thesis (so called ‘magazine programs’).”
